Regulations

 

The following Regulations determine the rules concerning the use and the rights and obligations of the users of the www.vivet.tv service, owned and administered by PERMA sp. z o.o. with its registered office at ul. Św. Marcina 29/8, 61-806 Poznań, (KRS number: 0000640648; NIP: 7792447759, REGON: 365586721).

  • 1. Definitions.

The terms included in these Regulations have the following meaning:

  1. Administrator – PERMA sp. z o.o. with its registered office at ul. Św. Marcina 29/8, 61-806 Poznań (KRS number: 0000640648; NIP: 7792447759, REGON: 365586721);
  2. User – a natural person of age using or visiting the service, conducting both public or private transmissions within the service as well as not conducting transmission activities.
  3. Regulations – these regulations concerning the use of the service that is always available at: https:// vivet.tv/regulations.
  4. Service – the web portal under the domain www.vivet.tv that allows users to use common space on the Internet and establish interpersonal relationships of a social network nature.
  5. Coin – a virtual unit which the user may use only within the service in order to establish relationships with other users or unlock the content offered by other users.
  6. Public transmission – a process of transmitting by a user of audio or video content to other users, accessible to all users within the service.
  7. Private transmission – a process of transmitting by a user of audio or video content to other user or users, selected and specified by the transmitter.

 

  • 2. General provisions.
  1. The condition of using the service is that the user is of age. The user makes a declarations that he is at least 18 years old at the time of registration in the service and at each access to the service.
  2. The user is strictly obliged to comply with the regulations and the generally applicable law or the rights of third parties and declares that he has all rights to the content he presents.
  3. The user represents that he is aware that the audio and video content presented on vivet.tv by other users are not moderated in a continuous and uninterrupted manner but only randomly or in the event of a suspected infringement of the provisions of law – to the extent technically, organisationally and personally feasible on the part of the administrator, they may be vulgar, contain erotic and pornographic content, and may also be considered and perceived as offensive content.
  4. The user shall not:
  5. Transmit any content that infringes the law, including copyright, and in particular the works to which he does not have any legal title such as: films, TV series, tv programmes, etc.;
  6. Placing in transmissions any images of third parties without their express consent;
  7. Present content and behave in a manner infringing the provisions of the Act of 6 June 1997 – Penal Code (Journal of Laws of 1997 No. 89, item 553 as amended), in particular the content or behaviour having the features of the offenses referred to in Article 197 – 204 of the Penal Code;
  8. Violate the good name, dignity and honour or other personal property of other users unless they explicitly agree to such behaviour;
  9. Advertise any products or services;
  10. Record the transmissions of other users and distribute, disseminate or use them within the service or outside it;
  11. Transfer or share to other users any personal data, contact details, service addresses, etc.;
  12. Organise games of chance within the service with a stake or prize being the coins acquired in the service;
  13. Offering a payment in any form outside the service will result in complete or partial blocking of access to the service.
  14. Providing any contact details, service addresses or other data enabling contact outside the service will result in a complete or partial blocking of access to the service. By registering in the service the user agrees to receive by e-mail messages (also advertising ones) from the company being the owner of the service or the service alone.

  16. The user uses the service voluntarily and therefore may remove his account at any time.
  17. In the event of a breach by the user of any provision of the regulations, the administrator may block the user’s account in the service without prior warning.
  18. In the event of the user’s breach of the law, the administrator, as soon as he asserts the fact, immediately blocks the user’s account in the service without notice. At the same time, both in the event of the user’s breach of the law and suspicion of a breach of the law, the administrator will fully cooperate with the competent law enforcement authorities and in the case when the administrator is the one to ascertain such infringements – he may notify the competent law enforcement authorities of the suspicion of a criminal offense committed by the user.
  19. Any doubt as to the age of the user may result in an immediate blocking of the user’s account in the service by the administrator.
  20. The user represents that he is fully aware of and acknowledges the fact that the content presented within the service by other users are not owned by the administrator, are not controlled or moderated by him, and therefore may be vulgar, pornographic, offensive or the like.
  21. The service’s administrator logs users’ IP addresses, to which the user agrees.
  22. The service’s administrator continuously controls the violations of law or the regulations within the service and blocks any content which breaches the regulations or the law, which may result also in blocking the account of the user presenting such content. The administrator also has the right to block the funds or coins associated in any way with the content that breaches the regulations or the law, which subsequently are forfeited to the administrator.
  23. The Regulations are effective in each field of operation of the service, including as regards private transmissions.
  24. An amendment to the Regulations enters into force upon publication at: https://vivet.tv/regulations of the new content of the regulations.

 

  • 3. Transmissions.
  1. Within the service the users can conduct public and private transmissions.
  2. The administrator or the service does not record the users’ transmissions in any form.
  3. It is prohibited to record, reproduce or disseminate the transmissions in any form.
  4. During a transmission (public as well as private) the user who is transmitting must be permanently and continuously clearly visible for the users participating in the transmission in the form "live". It is prohibited to present previously recorded images or sounds in place of a “live” transmission or replace it with the use of other means. Transmissions in breach of these rules will be interrupted by the administrator and the account of the user conducting such a transmission may be blocked.
  5. During a transmission the user who is transmitting may collect coins from other users on the terms established by him and for the purposes specified by him.
  6. Both users who are transmitting as well as those participating in the transmission may not offer one another payment in any form outside the service or provide any details enabling contact outside the service. Such behaviour constitutes a breach of the regulations and result in blocking the user’s account in the service.

 

  • 4. Coins.
  1. Within the service the user uses coins which he buys in the service by making a payment with a card, by transfer, through an SMS or in other form admissible in the service. Transactions within the service are supported by authorised payment services.
  2. The user purchases one coin for an amount that is currently shown in the process of purchasing and he can purchase a minimum of 100 coins in a single transaction.
  3. The user may transfer the coins to other users, which he does independently, voluntarily and on his own account and responsibility.
  4. The user may withdraw the funds equivalent to the coins received from other users (of at least 1,000 coins for one withdrawal transaction) to his bank account kept in a bank in the territory of the Republic of Poland. In the case of withdrawal to a bank account, the funds are paid to the user in the amount reduced by the commission due the administrator.
  5. In the case of coins purchased by the user for use in the service that were not fully used, the user may withdraw these funds (of at least 1,000 coins for one withdrawal transaction) to his bank account kept in a bank in the territory of the Republic of Poland. In the case of withdrawal to a bank account, the funds are paid to the user in the amount reduced by the commission due the administrator.
  6. The user may not facilitate the exchange of coins between one user and another. Coins may be accepted by the user only on his bank account and account in the service.
  7. Suspicious or questionable transactions of purchase of coins or withdrawal of funds being their equivalent (in particular from the point of view of legal regulations preventing the so-called money laundering) result in a suspension of the transactions of purchase or withdrawal of funds. In addition, the administrator may block the service’s account of the user who made an attempt to carry out a suspicious transaction. The user has the right to lodge a complaint regarding the suspension of the transaction or blocking the account in the service.
  8. In the case when the user removes his account in the service, the coins assigned to his account expire upon the removal of the account.
  9. In the case of blocking the user’s account in the service by the administrator, the user loses the possibility to use the coins or withdraw the funds being an equivalent of the coins assigned to the account until the administrator unblocks his account.
  10. The user who withdraws the funds being an equivalent of the coins assigned to the account to the bank account is fully and solely responsible for the fulfilment of any tax liabilities or settlement of any taxes, both income and sales taxes.

 

  • 5. Complaints.
  1. The user has the right to lodge a complaint regarding the operation of the service, including in particular regarding the behaviour of other users, the conducted transmissions, blocking his account by the administrator or infringements of the regulations.
  2. Subject to the mandatory provisions of the law, under penalty of rejection of the complaint, complaints should be lodged within 14 days of the event giving rise to the complaint, excluding complaints concerning the transmissions conducted by users, in which case it is possible to lodge a complaint only until the end of the transmission.
  3. A complaint can be lodged in writing to the administrator’s address indicated in the tab "contact" in the service or electronically to the e-mail address: contact@vivet.tv, or by using the "Report" button in the event of complaints regarding the transmissions of other users.
  4. A complaint contains at least:
  5. Indication of the user who lodges the complaint together with the appropriate address (it is sufficient to give an active e-mail address);
  6. Description of the event to which the complaint together with an indication of the period of its occurrence;
  7. Specification of the user’s demand;
  8. Signature of the user lodging the complaint (not applicable to complaints lodged in a manner other than in writing).
  9. The administrator will inform the user about the decision regarding the complaint in the form in which it was received, however, in the case of complaints lodged by using the "Report" button – in the form of an e-mail addressed to the e-mail address indicated by the user. Settlement of the claim means the notification to the user of recognising or rejecting the complaint.
  10. A response to a complaint contains at least:
  11. Determination whether the complaint has been recognised;
  12. If the complaint is recognised – determination of the method of settlement thereof;
  13. If the complaint is not recognised – justification of such decision.
  14. The administrator considers complaints within a period of not more than 7 days.
  15. It is prohibited to lodge a complaint regarding the fact of rejecting the complaint or re-submission of a complaint concerning the same event when the user previously lodged a complaint. Such re-submitted complaint will not be considered by the administrator.
  16. A user participating in a private transmission has the right to lodge a complaint with the administrator regarding the transmission when the transmission breaches the regulations, the law, is incompatible with the course declared by the transmitter or is not conducted by the transmitter. In the event of lodging such a complaint, the administrator blocks the coins provided by the user to the transmitter for conducting a private transmission. The coins will be unblocked after the administrator considers the complaint. If the complaint is recognised, the administrator transfers the coins to the account of the user participating in transmission and if the complaint is not recognised – the coins will be provided to the transmitter.
  17. Interruption of a private transmission during conduct thereof by the transmitter will result in a refund of the coins to the viewer.
  18. Interruption of a private transmission during conduct thereof by the viewer will result in a forfeiture of the coins to the transmitter.
  19. Any doubts as to the complaints regarding a private transmission may be considered by the administrator at his will and in his sole discretion.

 

  • 6. Final provisions.
  1. The Regulations are available to the users in the service at: https://vivet.tv/regulations and is presented and accepted in the course of user registration in the service.
  2. In the case of matters not regulated in the regulations the generally applicable regulations of the Polish law shall apply.
  3. The Regulations will enter into force on 15/03/2018.

Privacy Policy

 

The privacy policy applied by PERMA sp. z o.o. with its registered office at ul. Św. Marcina 29/8, 61-806 Poznań (KRS number: 0000640648; NIP: 7792447759, REGON: 365586721) for the service www.vivet.tv.

  • 1. General provisions
  1. This document, hereinafter referred to as "Privacy Policy" or "PP", lays down the rules for the collection and processing of personal data by the service administrator.
  2. The service administrator, i.e. PERMA sp. z o.o. with its registered office at ul. Św. Marcina 29/8, 61-806 Poznań, is the administrator of personal data collected from service Users.
  3. The PP does not specify the conditions of use of the service indicated in the Regulations.
  4. The service administrator takes all the measures required by the generally applicable law with regard to the collection and processing of personal data.
  5. The provision of personal data to the service Administrator is completely voluntary but the lack of provision thereof may hinder or in some cases prevent the use of the service. The user has the right to withdraw his consent, at any time, to the processing of his personal data given to the service Administrator. The user may withdraw his consent to the processing of his personal data at any time through a relevant message using the contact form at www.vivet.tv (contact tab)
  6. The user has the right to review his personal data at any time in order to verify, modify or delete them. The user can view his personal data via the User Panel at www.vivet.tv where he may also verify or modify them or demand deletion thereof.
  7. The service Administrator is obliged to delete the personal data of the User at his request without undue delay, but no later than 30 days after receipt of such request. The User may address such a request at any time via the User Panel at www.vivet.tv. The service Administrator informs the User of the removal of his personal data.
  8. The User has also the right to requests from the service Administrator to limit the processing of personal data as well as the right to object to the processing of his personal data by the Administrator. The User may exercise these rights at any time via the User Panel at www.vivet.tv. The service Administrator informs the User of limiting the processing of personal data or suspending their processing in connection with the received request or opposition of the User.
  9. The personal data of Users will be kept by the service Administrator throughout the lifetime of the user account and after it has been removed for a period and to the extent necessary to clarify the circumstances of any use of the service contrary to the law.
  10. The User has the right not to be affected by decisions resulting in legal effects towards him or similar effects significantly affecting him that are based on the processing of his personal data only in an automated manner (with the use of computer systems), including using data profiling. The User may object to the processing of his personal data only in an automated manner (with the use of computer systems), including using data profiling, via the User Panel at www.vivet.tv, while the service Administrator has the obligation to comply with such objection.
  11. In the event of a breach by the service Administrator of the rules and regulations regarding the processing of personal data, the User may file a complaint with the Inspector General for the Protection of Personal Data or to the President of the Office for the Protection of Personal Data. If the breach caused damage to the User or infringed his personal rights, the User has the right to claim compensation/redress from the Administrator before a common court.

 

  • 2. Scope of data collection.
  1. The use by the User of the free components of the service requires the provision of the following data:
  2. E-mail address,
  3. Login,
  4. IP address, by automatic identification of the user by the system of www.vivet.tv
  5. The use by the User of the paid components of the service may require – in addition to the data referred to in paragraph 1 – the provision of:
  6. First and last name,
  7. Address of residence,
  8. Correspondence address if different than the address of residence,
  9. Phone number.
  10. After the removal of the account by the User the service Administrator processes the data listed in paragraphs 1 and 2 only for the purposes of:
  11. Settlement with the User,
  12. Necessity to clarify the circumstances of a use of the service that is contrary to the law,
  13. Advertising, market research as well as research regarding the behaviour and preferences of users – with the explicit consent of the User.

 

  • 3. Use of data.
  1. The service Administrator processes the personal data of Users during their use of the service with the consent of the User only for the purposes of the use of the service, for marketing purposes or for the purpose of managing the payments for paid components of the service.
  2. In the event that the service Administrator was to use the personal data for purposes other than those referred to in paragraph 1, he is obliged to obtain the consent of the User before processing it.
  3. The personal data of Users may be made available to the relevant authorities or bodies within the limits of their competence referred to in the provisions of the common law, including e.g. courts, public prosecutors or the police.
  4. The personal data of Users may be made available to third parties supporting the payments for paid components of the service, provided the user expressed his consent. Lack of consent from the User may impede or in some cases prevent the provision of paid components of the service.
  5. In the event of a change in the purpose of the processing of personal data, the service Administrator informs the User of this fact. The User may consent to such change or refuse to give consent.

 

  • 4. Protection of personal data.
  1. During the processing of personal data of Users the service Administrator observes all generally applicable laws governing this matter, including in particular the provisions of the Act of 29 August 1997 on the protection of personal data and of the implementing provisions to this Act, as well as the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Regulation on the Protection of Personal Data).
  2. The exchange of data between the User and the service Administrator in the course of using the service is encrypted using a secure SSL connection.

 

  • 5. Changes to Privacy Policy.
  1. If there are changes or supplements to the PP, the service Administrator will inform the Users about the planned change or supplements electronically to the e-mail address assigned to the given User’s account and also publish a relevant generally available message in the service.
  2. In the absence of consent of the User to the changes or supplements of the PP, he will have the right to request the removal of his personal data by the service Administrator.

 

  • 6. Cookies.
  1. Service uses cookie files (so-called "cookies").
  2. The entity placing cookies on the User’s terminal equipment and receiving access thereto is the service Administrator.
  3. Cookies are IT data stored on the User’s terminal equipment and designed to use the web pages of the service.

  5. The service Administrator uses cookies to:
  6. Generate statistics regarding the forms of use of the service by Users, which improves their structure and content,
  7. Maintain Users’ sessions in connection with logging to the service owing to which the User does not have to re-enter the login and password on subsequent pages when using the service.
  8. Web browsers often allow to store cookies on the User’s terminal equipment by default. Each User has the possibility to change the browser settings in this regard and to delete these files from his equipment.
  9. The restriction of the use of cookies may affect the operation of and access to the content of the service.

 

INFORMATION FOR USERS AND CONSENTS AND DECLARATIONS OF USERS.

  1. As a User of the www.vivet.tv service I declare that I have read the above Privacy Policy, I understand its content, I find it clear and precise and I accept it in its entirety.
  2. I acknowledge that PERMA sp. z o. o. with its registered office at ul. Św. Marcina 29/8, 61-806 Poznań is the Administrator of the www.vivet.tv service and the Administrator of the personal data provided by me.
  3. I willingly and knowingly consent to the collection and processing of my personal data which I have provided in the form in the registration process in the www.vivet.tv service by the Administrator being PERMA sp. z o.o.
  4. I willingly and knowingly consent to the processing of my personal data by PERMA sp. z o.o. for the purposes of:
  5. Correct use of the service,
  6. Making settlements with the service Administrator for paid service components.
  7. I willingly and knowingly consent to the processing of my personal data by PERMA sp. z o.o. for the purposes of direct marketing or collecting statistical data on the forms of use of the service.
  8. I am aware that my personal data may be made available by PERMA sp. z o.o. to relevant services or public authorities within the limits of their competence as defined in the provisions of the Polish law, including e.g. courts, prosecution or the police.
  9. I consent to the transfer by PERMA sp. z o.o. of my personal data to the entities supporting the payments in the www.vivet.tv service or to the entities keeping the accounts of PERMA sp. z o. o. for the purposes of correct accounting of settlements for my use of paid service components.
  10. I am aware that PERMA sp. z o.o. or the hosting operator may save information about connection parameters (e.g. indication of time, IP address, location), to which I agree willingly.
  11. I am aware that the provision of personal data is not a condition for using the www.vivet.tv service, but I am well aware that the absence of relevant personal data or refusal to consent to their processing may significantly limit or sometimes prevent the use of the service.
  12. I am aware that the personal data provided by me will be kept by PERMA sp. z o.o. throughout the lifetime of the user account and after it has been removed for a period and to the extent necessary to clarify the circumstances of any use of the www.vivet.tv service contrary to the law.
  13. I am aware that I have the right to review the personal data I provided and I can access them in the User panel in the www.vivet.tv service at any time.
  14. I am aware that I can at any time request PERMA sp. z o.o. to correct the personal data I provided or delete them, which I can do in the User panel in the www.vivet.tv service at any time.
  15. I am aware that I can at any time request PERMA sp. z o.o. to limit the processing of the personal data provided by me, in particular if they are incorrect or where the processing takes place contrary to the law, which I can do in the User panel in the www.vivet.tv service at any time.
  16. I am aware that I can at any time report an objection to PERMA sp. z o.o. regarding the processing of the personal data provided by me, which I can do in the User panel in the www.vivet.tv service at any time.
  17. I am aware that I can at any time request PERMA sp. z o.o. to make the personal data provided by me available to me in an electronic file saved in a commonly used format, which I can do in the User panel in the www.vivet.tv service at any time. In addition, I know that I can transfer the data to another entity of my choice or require that PERMA sp. z o.o. directly transfers the data to an entity chosen by me.
  18. I am aware that I can at any time withdraw the consents granted to PERMA sp. z o.o to the processing of the personal data provided by me, which I can do in the User panel in the www.vivet.tv service at any time. I am aware that withdrawal of the consent to the processing of personal data does not affect the legality of their processing under the consent I granted earlier.
  19. I am aware that I can at any time request PERMA sp. z o.o. to remove all personal data provided by me, which I can do in the User panel in the www.vivet.tv service at any time. I am well aware that PERMA sp. z o.o. has the right not to remove the personal data whose processing obligation has been imposed on the service Administrator by the provisions of the Polish law or of the law of the European Union.
  20. I am aware that I have the right not to be affected by decisions resulting in legal effects towards me or similar effects significantly affecting me that are based on the processing of my personal data only in an automated manner (with the use of computer systems), including using data profiling. I am aware that I may object to the processing of my personal data only in an automated manner (with the use of computer systems), including using data profiling, which I can do via the User Panel at www.vivet.tv at any time.
  21. I am aware that in the event of a breach by PERMA sp. z o.o. of the rules and regulations regarding the processing of my personal data, I can file a complaint with the Inspector General for the Protection of Personal Data or to the President of the Office for the Protection of Personal Data. Coins – the virtual currency of Vivet.tv

 

  1. What are coins and what is their purpose?

Coins are a virtual currency of vivet.tv. You can buy them, withdraw them or transfer them to another user e.g. in the form of a tip.

  1. Purchase of coins

You can buy coins at any time. Simply click “Buy coins", select the appropriate package of coins and click the "top up" button. You will be redirected to the payment system, where, following the instructions, you will pay for the coins.

  2. a) Tip – in order to transfer the coins to the transmitter simply enter how many coins you want to transfer in the “Send a tip” field and click "Send". Coins will be automatically deducted from your account and will credit the account of the transmitter. Remember: You cannot undo this operation.
  3. b) Private transmission – When users wish to have more privacy and intimacy they can switch to a private transmission, which will be viewed only by them. Only 2 persons participate in such a transmission – the transmitter and the viewer. The transmitter sets the time, price (number of coins), as well as a description of the private transmission. To enter a private transmission simply click the "Private transmission" button, select your preferred transmission and then click "Send invitation". Coins will be automatically deducted from your account and will credit the account of the transmitter reference after the end of the transmission.
  4. Withdrawal of coins

When you have an appropriate number of coins in your wallet, you can convert them into real currency. Just use the "Withdraw coins" tab or enter the "Coins" tab on your account. There you enter only the number of coins you want to withdraw and the number of the bank account on which money is to be credited. Money will be credited on the account within 7 working days of withdrawal thereof. Remember that you can withdraw 1000  coins as a minimum.

Registration and use of the VIVET.TV service is completely free.

A public transmission is visible and available to every user of our service. In a public transmission the participants can chat with each other and watch the transmitter’s transmission. When users wish to have more privacy and intimacy they can switch to a private transmission, which will be viewed only by them.

  1. Where do I get coins from?

You can get coins in several ways. The simplest is to purchase coins via the "Buy coins" tab. You can select the relevant package of coins there, after which you will be redirected to the payment system. After completion of the transaction coins appear in the wallet on your profile. The second way is to receive coins from another user of VIVET.TV. You can achieve this by conducting a public transmission during which you will receive tips, or inviting other users to a private transmission.

When you have an appropriate number of coins in your wallet, you can convert them into real currency. Just use the "Withdraw coins" tab or enter the "Coins" tab on your account. There you enter only the number of coins you want to withdraw and the number of the bank account on which money is to be credited. Remember that you can withdraw 1000  coins as a minimum.
